EU Launches Formal Antitrust Investigation Against Google Over AI Content Use

The European Commission has announced the opening of a formal antitrust investigation to assess whether Google has abused its dominant market position by using content from web publishers and YouTube for its Artificial Intelligence (AI) products, potentially breaching EU competition rules.

The probe will focus on whether Google is imposing unfair terms and conditions on publishers and content creators, or granting its own AI models, such as “AI Overviews” and “AI Mode”, privileged access to content, thereby disadvantaging developers of rival AI technologies.

According to the Commission, many publishers rely heavily on Google Search for user traffic and may feel compelled to allow Google to use their content for AI purposes without appropriate compensation, for fear of losing access to the vital search platform.

Executive Vice-President Teresa Ribera commented on the decision, stating: “A free and democratic society depends on diverse media, open access to information, and a vibrant creative landscape. AI is bringing remarkable innovation… but this progress cannot come at the expense of the principles at the heart of our societies.”

The investigation is centred on potential breaches of Article 102 of the Treaty on the Functioning of the European Union (TFEU), which prohibits the abuse of a dominant position.

The Commission has informed Google and the competition authorities of the EU Member States about the formal opening of proceedings. The launch of the formal investigation signifies a priority for the Commission but does not prejudge the outcome of the case. No legal deadline has been set for the conclusion of the antitrust investigation.

The case, designated as AT.40983, marks the latest regulatory action taken by the EU to ensure fair competition and protect content creators in the rapidly evolving digital and AI landscape.
